copy pasted from a journal on my FA and DA, but here I will reveal her identity to see if anyone knows her and could possibly help me out here. Also, this is my first post here so if I did anything wrong I appologise in advance.

also, I'm curious if I am the only one having trouble with her aswell

So, I commissioned shoes from someone a looong time ago (over a year maybe??)
so, I paid and waited.
she sent me a wip picture a few weeks after and they were looking great, almost finished.
then, about a month after, she told me she was moving and that I'll have to wait until she gets settled. understandable of course.
she hasnt contacted me until about two months later when she apparently was finally settled, telling me that the shoes have been lost.
a few days after she said she found them and I gave her my address for her to ship them off.
another two months later (shes had many journals saying how tough life is and all that so i let her be) she said she'll send them out when she has a chance.
ive been waiting two months, then I asked my sister for help, so she sent her a message demanding the shoes or a refund.
she sent this to me after:

Hey sweetie,
I"m so sorry I havnt gotten a hold of you sooner. A lot of things have been going on in my life, I hardly have time for anything anymore. I'm sure by now you have heard from your sister that your shoes have been lost. My step father didnt pay the bill for our storage and didnt tell me until just recently that I have lost all of my personal belongings, including my art supplies and my childhood items...
I am going to refund your money to you. If you could, please send me your address so I can send the money out to you.
Once again, I am very sorry this has happened, I really had no intention of this happening and I hope there are no grudges held, you are a very sweet person.

that was three weeks ago. I'm still waiting for the money.
also, apparently they were lost even though she found them and was ready to ship them off a few months ago?

So...umm...what should I do here? any advice? 

 

{edit} ok, so i sent her a note with the link to this and everything and she said she gave the money to her mother who should be mailing it soon, and she'll try to find the shoes to send me.

still not resolved though, I dont think I can trust that to happen until it really does after all those unfulfilled promises.

I'm confused. You paid her via PayPal, but she isn't capable of paying you back via PayPal?

If it's been long enough since the original payment, paypal may not allow her to use the "refund" feature, and thus she'd have to send the money as a payment to you, which would mean paypal taking out their fees from it a second time, so she'd either have to send extra or you'd get not quite as much as you originally paid. This *might* be the reason why she's doing it that way.

Hmmmmm. Not sure what you can do at this point, other than send her regular reminders until you get your refund. It's entirely possible that she lost the shoes, found the shoes, and then lost them again, and is thus telling the truth. But since you apparently haven't seen a finished pic of them, it's also quite possible that she's lying through her teeth and has never had them finished in the first place.

Either way three weeks is a long time to wait after a promised refund, so I'd be getting on her case about the money if I were you.

The fact that she has told you she'll pay you back via your address rather than paypal which would be quicker, and easier for everyone involved, not to mention YOU especially since that's how you paid her in the first place, aaand the way she said "lost it :c", "found it! :)", "I lost all my things and life is hard and your shoes are gone :,c" I have a feeling that you might be waiting a looooong time for your money.

I can just imagine you sending her another message and her trying to play the "I'm going through some hard times and I need your money I'm sorry :c" card.


Getting caught up with life, I can totally understand.
Losing shoes in a move, even though they're a PAID for commission, I can kinda understand though I often think it's unlikely.
Finding shoes, then magically claiming to have lost them again, and then needing your address to send you money? Nah, not buying it, not for one second.

I'm not entirely sure what you can do at this point aside keeping sending her regular reminders. Please keep us update though!

If the money's not gone out yet, tell her she better get delivery confirmation/tracking on that envelope, or some sort of proof that it's been sent off when she does so. I have a feeling you're not far from dealing with "sorry, money got lost in transit, you're sol."

Could be the reason she wanted to mail the refund money in the first place. Because she wasn't actually intending to mail it at all but planned to say it got lost in the post all along. I hope this isn't the case but given the account so far, it's definitely a possibility

This is pretty off topic but... WHY is she calling you sweetie? That would absolutely drive me up the wall if a customer of mine or an artist I commissioned started calling me pet names while giving me the run around. Extremely unprofessional, the whole thing.

I hope your money actually does come in the mail.

Dang... yeah that is weird about the Paypal thing. I recognize the person's work but I haven't heard anything bad about her... hmm.
